Welcome to TavernAI.Cards ("the Service", "we", "us", "the Service operator"). By creating an account or using the Service you agree to these Terms of Service. If you do not agree, do not use the Service.
1. Eligibility & Account
The Service is intended for users aged 18 or older. By signing up you confirm you meet this age requirement. Authentication is provided by Clerk; you are responsible for keeping your credentials secure and for all activity under your account.
2. User Content & Ownership
You retain all rights to the character cards, lorebooks, prompts, portraits, and other content you upload or create ("User Content"). We do not claim ownership of User Content.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, cache (including CDN edge caches), embed metadata (e.g. PNG tEXt chunks for the character card spec), transmit, display, generate thumbnails, transcode, sync, and modify your User Content (e.g. for format conversion, lint, and related operational purposes) for the sole purpose of operating the Service. This licence terminates when you delete the relevant content, except to the extent retention is required for legal compliance, dispute resolution, or backups.
3. Content Warranty
By uploading User Content, you represent and warrant that:
- You own the content or have all necessary rights to it.
- It does not infringe any third party's copyright, trademark, privacy, publicity, or other rights.
- It complies with these Terms, including the prohibitions below.
4. AI / Character Disclaimer
Character cards drive role-play conversations with third-party large language models. AI output is generated and may be inaccurate, offensive, or unsuitable for any particular purpose. Use AI output at your own risk and verify anything important. TavernAI.Cards does not author or endorse AI output, does not act as an advisor, agent, or fiduciary, and the Service does not constitute professional advice (legal, medical, financial, or otherwise). No advisory, fiduciary, or special relationship is created by your use of the Service.
5. Prohibited Conduct & Content
Users must not, and must not attempt to:
- Upload, generate, share, or store child sexual abuse material (CSAM), in any form, real or fictional, drawn or generated.
- Upload or generate any sexualised depiction of, or sexual scenario involving, minors — characters depicted as under 18, regardless of stated age, art style, or fictional framing.
- Upload real-person fakes (RPF) — sexual, defamatory, or harassing content depicting identifiable real individuals without consent. Public figures in clearly non-sexual, non-defamatory satire may be evaluated at our sole discretion.
- Upload content that incites violence, terrorism, or self-harm; content that promotes illegal acts; or content that violates any third party's intellectual property, privacy, publicity, or other rights.
- Upload, transmit, or distribute malware, viruses, or any code intended to disrupt, damage, or gain unauthorised access to systems, accounts, or data.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or underlying ideas of the Service, except to the extent such restriction is prohibited by applicable law.
- Scrape, crawl, harvest, index, or otherwise extract data from the Service by automated or manual means without our prior written permission; bypass, disable, or circumvent any rate limit, access control, authentication, or technical protection measure.
- Use the Service's APIs or endpoints in a manner that exceeds documented limits, generates excessive load, or that interferes with the Service's normal operation or other users' enjoyment of it.
- Resell, sublicense, or otherwise commercialise access to the Service without our prior written agreement.
We may, at our sole discretion and without obligation, remove any content and suspend or terminate any account that we believe violates these Terms, with or without notice. We do not proactively monitor or pre-screen User Content, and we make no representation that we will detect or address any particular violation.
6. NSFW & Adult Content
The Service permits fictional adult / NSFW content between adult characters, subject to Section 5 and applicable law. The Service is 18+ only. Public publication of NSFW content may become subject to additional moderation requirements in the future; we will update this section before any such change takes effect.
6A. User Content Risk & Mere-Conduit Role
You are solely responsible for your User Content and for any consequences of uploading, publishing, sharing, syncing, or otherwise transmitting it through the Service. You assume all risk associated with your User Content, including the risk that another party may rely on, copy, redistribute, or misuse it. The Service operator acts only as a hosting providerfor User Content; we do not author, curate, or endorse User Content and exercise no editorial control over its substance. Technical operations applied to User Content under the licence granted in Section 2 (e.g. format conversion, metadata embedding, thumbnail generation, lint) are not editorial control.
7. Visibility, Sharing & Cross-Posting
You control whether your cards are private, unlisted (shareable via secret link), or public. The sync feature lets you cross-post your cards to Chub.ai, RisuAI, or download them for SillyTavern under your own accounts on those platforms; the third-party platform's own terms apply to those copies. If you change a card's visibility or delete it, distributed copies on third-party platforms are not automatically removed.
8. DMCA & Copyright
We respond to valid copyright notices under the DMCA and equivalent regimes. See our DMCA page for the takedown procedure, counter-notice procedure, and repeat-infringer policy.
9. Termination
You may delete your account at any time via the Clerk-managed account UI. We may suspend or terminate your account for violations of these Terms, suspected fraud, or to protect the Service or other users. Upon termination your User Content is handled as described in our Privacy Policy, Section 5.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. To the maximum extent permitted by applicable law, we disclaim all warranties not expressly granted in these Terms.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. The operator's aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, or USD 100 if you paid nothing.
Nothing in this section limits liability that cannot be limited under applicable law.
12. Changes to these Terms
We may update these Terms as the Service evolves. The Last updated date and version number at the top of this page reflect the current revision. Material changes will be announced in the dashboard or via email; continued use of the Service after a change indicates acceptance.
These Terms may also be updated as the operational structure of the Service evolves, at which point additional identifying or jurisdictional details may be made explicit.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Service operator's primary place of business at the time of execution, which the operator does not publicly disclose for operational privacy reasons. Disputes shall first be addressed via good-faith negotiation through the published contact email; failing that, by binding arbitration on an individual (non-class, non-representative) basis. The arbitration shall be administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force at the time of submission, with the seat of arbitration in Hong Kong and proceedings conducted in English. The arbitral tribunal shall consist of one arbitrator appointed in accordance with the HKIAC Rules.
Nothing in these Terms limits any non-waivable rights you have as a consumer under your local law, including residents of the EU, the UK, the EEA, California, and Quebec, who retain the right to bring claims in their local courts where mandatory consumer protection law so provides.
14. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Service operator and its affiliates, contractors, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of, or inability to use, the Service; (c) your violation of these Terms; (d) your violation of any law or any third party's rights, including intellectual property, privacy, or publicity rights; or (e) any misrepresentation made by you. The Service operator reserves the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with the defense of such claim.
15. Force Majeure
The Service operator is not liable for any failure or delay in performance, including service outages, data loss, data corruption, or unavailability, resulting from causes beyond its reasonable control. Such causes include but are not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, civil unrest, government action, sanctions, embargoes, labor disputes, internet or telecommunications failures, denial of service or other cyberattacks, third-party platform outages (including hosting, authentication, payment, or AI providers), and changes in applicable law.
16. Severability & Waiver
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
